These Terms and Conditions ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("User", "you", or "your"), and GyftVoucher Inc. ("GyftVoucher", "we", "us", or "our"), concerning your access to and use of the https://www.gyftvoucher.com website as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the "Platform").
By accessing the Platform, you agree that you have read, understood, and agreed to be bound by all of these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the Platform and you must discontinue use immediately.
To use our Services, you must be at least 18 years of age and competent to enter into a legally binding contract under the Indian Contract Act, 1872. By using the Platform, you represent and warrant that you meet these eligibility requirements.
You may be required to register with the Platform to access certain features. Registration is facilitated via Google Single Sign-On (SSO) or Mobile One-Time Password (OTP). You agree to provide accurate, current, and complete information during the registration process and update such information to keep it accurate, current, and complete.
You are responsible for safeguarding the password and authentication methods that you use to access the Platform. You agree not to disclose your login credentials to any third party and to take sole responsibility for any activities or actions under your account, whether or not you have authorized such activities or actions.
GyftVoucher provides a comprehensive digital rewards platform offering the following Services:
All gift cards purchased on GyftVoucher are delivered electronically in the form of digital voucher codes. No physical cards will be shipped.
Gift cards are subject to the individual terms and conditions of the issuing brand. GyftVoucher is not responsible for the terms set by the brand, including expiration dates, redemption restrictions, or limitations on use.
Voucher validity periods are determined by the issuing brand. Once a voucher code has been viewed or redeemed, it is strictly non-transferable and cannot be refunded, exchanged, or canceled.
GyftVoucher acts solely as a marketplace facilitator for the sale of gift cards and digital vouchers. The underlying contract for the provision of goods or services against the gift card is exclusively between you and the respective brand.
Users may earn GyftCoins on qualifying purchases and platform activities. The rate of accrual is determined by GyftVoucher and may be subject to promotional variations.
GyftCoins can be redeemed for discounts on future purchases within the Platform. GyftCoins hold no cash value and cannot be exchanged for fiat currency.
GyftVoucher reserves the right to modify, suspend, or terminate the GyftCoins program at any time without prior notice. This includes altering the earning rates, redemption values, or expiration policies.
GyftCoins may expire in accordance with the policies communicated at the time of issuance or as updated on the Platform.
All prices listed on the Platform are in Indian Rupees (INR) unless otherwise explicitly stated.
We accept payments via Unified Payments Interface (UPI), valid Credit/Debit Cards, and Net Banking. All payments are processed through secure third-party payment gateways.
Pricing for all products, Services, and subscriptions is subject to change at the sole discretion of GyftVoucher without prior notice. However, changes will not affect orders that have already been confirmed and paid for.
The Platform and its original content, features, and functionality, including but not limited to the names "GyftVoucher", "RewardStack", "GV Toolkit", and "GyftCoins", are and will remain the exclusive property of GyftVoucher Inc. and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of GyftVoucher.
We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Platform for your personal, non-commercial use, subject to these Terms.
You agree not to engage in any of the following prohibited activities:
The Platform integrates with third-party services, including Hubble for gift card fulfillment and various payment gateways. Your use of these integrated services is subject to their respective terms of service and privacy policies. GyftVoucher is not responsible for the acts, omissions, or terms of third-party service providers or brand partners.
The Platform and Services are provided on an "AS IS" and "AS AVAILABLE" basis. GyftVoucher makes no representations or warranties of any kind, express or implied, as to the operation of their services, or the information, content, or materials included therein.
We do not guarantee that the Platform will always be safe, secure, or error-free, or that the Platform will function without disruptions, delays, or imperfections.
To the maximum extent permitted by law, GyftVoucher shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. In no event shall GyftVoucher's aggregate liability for any claims relating to the Services exceed the amount paid by you to GyftVoucher in the transaction giving rise to the claim.
You agree to defend, indemnify, and hold harmless GyftVoucher, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Platform or your violation of these Terms.
We may terminate or suspend your account and bar access to the Platform immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. Upon termination, your right to use the Platform will immediately cease.
These Terms shall be governed and construed in accordance with the laws of India. You agree that any legal action or proceeding arising out of or relating to these Terms or the Platform shall be brought exclusively in the courts located in India, and you hereby consent to the personal jurisdiction and venue therein.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Platform after those revisions become effective, you agree to be bound by the revised terms.
